These Terms and Conditions (“Terms”) govern your use of the services provided by Funding Loop Pty Ltd (“Funding Loop”, “we”, “us”, “our”), including our website, platform, tools, and any related services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not access or use our Services.

By using our Services, you represent and warrant that you meet these eligibility criteria.

Funding Loop is a marketplace platform that facilitates access to third-party financial services, including but not limited to:

  • Business funding through lenders and finance providers

  • Foreign exchange (FX) solutions

  • Card payment gateway services

We do not provide any financial products or services directly. Instead, we facilitate introductions and enable information exchange between business users and third-party financial service providers (“Partners” or “Product Providers”). All decisions regarding provision of services or products rest solely with the third-party providers.

We do not guarantee that:

  • Your application will be accepted

  • You will be matched to a provider

  • Any product or service offered will be suitable, competitive, or available

You should obtain independent financial or legal advice before accepting any offer from a provider.

4. Account Registration and Responsibilities

To access certain features, you may need to create an account. You agree to:

  • Provide true, complete, and up-to-date information

  • Keep your credentials secure

  • Notify us immediately of any unauthorised access

You are responsible for all activities under your account.

5. Use of Services

You must not use our Services to:

  • Violate any laws or regulations

  • Transmit spam or harmful code

  • Impersonate another person or organisation

  • Interfere with other users’ experience or security

We reserve the right to suspend or terminate access to anyone who breaches these Terms.

We are not liable for:

By using our Services, you agree to our Privacy Policy, which outlines how we collect, use, and share your data, including with Partners for the purpose of assessing and providing their services.

9. Disclaimer of Warranties

We do not warrant:

  • That the platform will be uninterrupted or error-free

  • That any service or product obtained through us will meet your expectations

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any:

  • Indirect or consequential losses

  • Business interruption, loss of profit, or data

  • Outcomes of third-party engagements

Our total liability under these Terms is limited to AUD $100.

11. Indemnity

You agree to indemnify Funding Loop Pty Ltd and its officers, employees, and agents against any claims, losses, or liabilities arising from:

  • Your use of the Services

  • Your breach of these Terms

  • Any dealings with third-party providers initiated through us

12. Termination

We may suspend or terminate your access at any time, without notice, if we believe you have violated these Terms or misused the Services.

13. Amendments

We may update these Terms at any time. Continued use of the Services after changes are published constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You agree to the exclusive jurisdiction of the courts of NSW.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other referenced documents, constitute the entire agreement between you and Funding Loop Pty Ltd.
